These Terms and Conditions (“Terms”) govern all services provided by Bellingham Bathworks (referred to as “Company,” “We,” “Us,” or “Our”) to the client (referred to as “Client” or “You”) regarding bathroom remodeling, renovation, and related construction services in the Bellingham, WA, and Whatcom County area. By engaging Our services, You agree to abide by these Terms.

1. Scope of Work and Estimates

Proposal: All work will be carried out as detailed in the separate, signed Project Proposal and Estimate (“Proposal”). The Proposal outlines the scope, materials, estimated timeline, and total cost.
Exclusions: Unless specifically included in the Proposal, services such as moving/storing Client belongings, cleaning dust from non-work areas outside the immediate construction zone, or remediation of hidden issues (e.g., mold, unforeseen structural problems, undocumented plumbing/electrical) are excluded.
Change Orders: Any deviation or change from the original Proposal, including material upgrades or additional work, must be documented in a signed Change Order. Change Orders will result in adjustments to the project cost and timeline.

2. Pricing and Payment Schedule

Initial Deposit: A non-refundable initial deposit (specified in the Proposal) is required to secure the project start date and order long-lead-time materials (e.g., custom glass, specialty tile).
Payment Milestones: Payments will be due in milestones as specified in the Proposal (e.g., upon project commencement, upon rough inspection, upon waterproofing completion, upon substantial completion).
Final Payment: The final payment is due immediately upon substantial completion of the bathroom, defined as the point when the bathroom is functionally complete (fixtures working, shower usable), regardless of minor final punch list items.
Late Payments: Payments not received by the due date may incur a late fee (maximum allowed by law) and may lead to a suspension of work until the account is settled.

3. Project Timeline and Delays

Estimated Timeline: The timeline provided is an estimate and reflects typical conditions. We strive to adhere to it but do not offer time-of-completion guarantees.
Causes for Delay: We are not responsible for delays caused by factors outside Our control, including material supply chain issues, delays in City/County permit approval, unforeseen site conditions (e.g., needing structural modifications), or Client delays.
Access: The Client must provide clear, safe, and uninterrupted access to the work area during agreed-upon working hours (typically Monday–Friday, 9:00 AM – 5:00 PM).

4. Client Responsibilities

The Client agrees to:

Clear the entire work area of all personal property and valuables before the start date.
Be responsible for the safety and welfare of all children and pets during construction activities.
Ensure all necessary utilities (water, power) are available and accessible to the work crew.
Promptly review and approve any samples, drawings, or Change Orders presented by the Company to avoid project stalling.

5. Warranties and Liability

Workmanship Warranty: We guarantee Our installation and construction workmanship for a period of one (1) year from the date of final payment. This warranty covers defects in installation (e.g., tile failure due to improper setting) only.
Material Warranty: All materials (fixtures, tile, venting, etc.) are covered solely by the manufacturer’s warranty. We will assist the Client in submitting claims but are not responsible for manufacturer defects.
Limitation of Liability: In no event shall Bellingham Bathworks be liable for any indirect, incidental, or consequential damages arising out of or related to the service. Our maximum liability is limited to the total contract price paid by the Client.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington. Any disputes arising under these Terms shall be resolved exclusively in the appropriate state or federal courts located in Whatcom County, Bellingham, WA.

7. Acceptance of Terms

By digitally accepting the Project Proposal or by making the initial deposit, the Client acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.
